At the 1994 annual awards dinner given for Forensic Science, AAFS President Dr Don Harper Mills astounded his audience with > > the legal complications of a bizarre death.
Here is the Case:
On March 23, 1994 the medical examiner viewed the body of Ronald Opus and concluded that he died from a shotgun wound to the head. Mr. Opus had jumped from the top of a ten-story building intending to commit suicide. He left a note to the effect indicating his despondency .As he fell past the ninth floor his life was interrupted by a shotgun blast passing through a window, which killed him instantly.
Neither the shooter nor the deceased was aware that a safety net had been installed just below the eighth fl! oor level to protect some building workers and that Ronald O pus would not have been able to complete his suicide the way he had planned. "Ordinarily," Dr Mills continued, "A person, who sets out to commit suicide and ultimately succeeds, even though the mechanism might not be what he intended, is still defined as committing suicide." That Mr. Opus was shot on the way to certain death, but probably would not have been successful because of the safety net, caused the medical examiner to feel that he had a homicide on his hands. In the room on the ninth floor, where the shotgun blast emanated, was occupied by an elderly man and his wife. They were arguing vigorously and he was threatening her with a shotgun. The man was so upset that when he pulled the trigger he completely missed his wife and the pellets went through the window striking Mr. Opus. When one intends to kill subject "A" but kills subject "B" in the attempt, one is guilty of the murder of subject "B".
When confronted with the murder charge the old man and his wife were both adamant and both said that they thought the shotgun was unloaded. The old man said it was a long-standing habit to threaten his wife with the unloaded shotgun. He had no intention to murder her. Therefore the killing of Mr. Opus appeared to be an accident;that is, if the gun had been accidentally loaded. The continuing investigation turned up a witness who saw the old couple's son loading the shotgun about six weeks prior to the fatal accident.
It transpired that the old lady had cut off her son's financial support and the son, knowing the propensity of his father to use the shotgun threateningly, loaded the gun with the expectation that his father would shoot his mother.Since the loader of the gun was aware of this, he was guilty of the murder even though he didn't actually pull the trigger. The case now becomes one of murder on the part of the son for the death of Ronald Opus. Now comes the exquisite twist. Further investigation revealed that the son was, in fact, Ronald Opus.
He had become increasingly despondent over the failure of his attempt to engineer his mother's murder. This led him to jump off the ten-story building on March 23rd, only to be killed by a shotgun blast passing through the ninth story window. The son had actually Murdered himself, so the medical examiner closed the case as a suicide.
A true story from Associated Press, Reported by Kurt Westervelt
Recently reported in the Massachusetts Bar Association Lawyer's Journal, the following are 22 questions actually asked of witnesses by attorneys during trials and, in certain cases, the responses given by insightful witnesses:
1. "Now doctor, isn't it true that when a person dies in his sleep, he doesn't know about it until the next morning?" '
2. "The youngest son, the twenty-year old, how old is he?"
3. "Were you present when your picture was taken?"
4. "Were you alone or by yourself?"
5. "Was it you or your younger brother who was killed in the war?"
6. "Did he kill you?"
7. "How far apart were the vehicles at the time of collision?"
8. "You were there until the time you left, is that true?"
9. "How many times have you committed suicide?"
10. Q: "So the date of conception (of the baby) was August 8th?" A: "Yes." Q: "And what were you doing at that time?"
11. Q: "She had three children, right?" A: "Yes." Q: "How many were boys?" A: "None." Q: "Were there any girls?"
12. Q: "You say the stairs went down to the basement?" A: "Yes." Q: "And these stairs, did they go up also?" 13. Q: "Mr. Slatery, you went on a rather elaborate honeymoon, didn't' t you?" A: "We went to Europe, sir." Q: "And you took your new wife?"
14. Q: "How was your first marriage terminated?" A: "By death." Q: "And by who's death was it terminated?"
15. Q: "Can you describe the individual?" A: "He was about medium height and had a beard." Q: "Was this a male or a female?"
16. Q: "Is your appearance here this morning pursuant to a deposition notice which I sent to your attorney?" A: "No, this is how I dress when I go to work."
17. Q: "Doctor, how many autopsies have you performed on dead people?" A: "All my autopsies are performed on dead people."
18. Q: "All your responses must be oral, okay? What school did you go to?" A: "Oral."
19. Q: "Do you recall the time you examined the body?" A: "The autopsy started around 8:30 p.m.." Q: "And Mr. Dennington was dead at the time?" A: "No, he was sitting on the table wondering why I was doing an autopsy."
20. Q: "You were not shot in the fracas?" A: "No, I was shot midway between the fracas and the navel."
21. Q: "Are you qualified to give a urine sample?" A: "I have been since early childhood."
22. Q: "Doctor, before you performed the autopsy, did you check for a pulse?" A: "No." Q: "Did you check for blood pressure?" A: "No." Q: "Did you check for breathing?" A: "No." Q: "So, then it is possible that the patient was alive when you began the autopsy?" A: "No." Q: "How can you be so sure, Doctor?" A: "Because his brain was sitting on my desk in a jar." Q: "But could the patient have still been alive nevertheless?" A: "It is possible that he could have been alive and practicing law somewhere."
We'll begin with a box, and the plural is boxes, but the plural of ox became oxen not oxes. One fowl is a goose, but two are called geese, yet the plural of moose should never be meese. You may find a lone mouse or a nest full of mice, yet the plural of house is houses, not hice.
We'll begin with a box, and the plural is boxes, but the plural of ox became oxen not oxes. One fowl is a goose, but two are called geese, yet the plural of moose should never be meese. You may find a lone mouse or a nest full of mice, yet the plural of house is houses, not hice. If the plural of man is always called men, why shouldn't the plural of pan be called pen? If I spoke of my foot and show you my feet, and I give you a boot, would a pair be called beet? If one is a tooth and a whole set are teeth, why shouldn't the plural of booth be called beeth?
Then one may be that, and three would be those, yet hat in the plural would never be hose, and the plural of cat is cats, not cose. We speak of a brother and also of brethren, but though we say mother, we never say methren. Then the masculine pronouns are he, his and him, but imagine the feminine, she, shis and shim.
Let's face it - English is a crazy language. There is no egg in eggplant nor ham in hamburger; neither apple nor pine in pineapple. English muffins weren't invented in England. We take English for granted. But if we explore its paradoxes, we find that quicksand can work slowly, boxing rings are square, and a guinea pig is neither from Guinea nor is it a pig.
And why is it that writers write but fingers don't fing, grocers don't groce and hammers don't ham? Doesn't it seem crazy that you can make amends but not one amend? If you have a bunch of odds and ends and get rid of all but one of them, what do you call it?
If teachers taught, why didn't preachers praught? If a vegetarian eats vegetables, what does a humanitarian eat? In what other language do people recite at a play and play at a recital?
We ship by truck but send cargo by ship. We have noses that run and feet that smell. And how can a slim chance and a fat chance be the same, while a wise man and a wise guy are opposites? You have to marvel at the unique lunacy of a language in which your house can burn up as it burns down,
in which you fill in a form by filling it out, and in which an alarm goes off by going on. So if Father is Pop, how come Mother isn't Mop. And if Mum is Mummy, then Daddy must be Dummy!!
It's always good to know these things..... This is a very good article. Not only about the warm water during and after your meal, but about ladies and their heart attacks. This makes sense....
the Chinese and Japanese drink hot tea with their meals.....not cold water..... maybe it is time we adopt their drinking habit while eating!!!
Nothing to lose, everything to gain.....they have a much, much lower heart attack rate than we do. For those who like to drink cold water, this article is applicable to you. It is nice to have a cup of cold drink after a meal. However, the cold water will solidify the oil in the food that you have just consumed. It will slow down the digestion. Once this "sludge" reacts with the acid, it will break down and be absorbed by the intestine faster than the solid food. It will line the intestine. Very soon, this will turn into fat and could lead to cancer. It is best to drink hot soup or warm water (tea or coffee) during and after a meal.
A serious note about HEART ATTACKS:
Women should know that not every heart attack symptom is going to be the left arm hurting. Be aware of intense pain in the jaw line. You may never have the first chest pain during the course of a heart attack. Nausea and intense sweating are also common symptoms. 60% of people who have a heart attack while they are asleep do not wake up. Pain in the jaw can wake you from a sound sleep. Let's be careful and be aware. The more we know, the better chance we could survive...... A cardiologist says if everyone who gets this mail sends it to 10 people, you can be sure that we'll save at least one life. Read this....... It could save your life!!
and if you think your english is damn GOOD..see if you know these words!! haha
